Terms of Service

These terms govern your access to and use of The Maritime, operated by The Maritime A.Ş. (“The Maritime”, “we”). By accessing the platform, by any means, you accept them in full. If you do not accept them, you have no right to access the platform.

Ownership & intellectual property

The platform, its database, and everything on it — the compilation, selection, structure and arrangement of the data, the derived scores, indices, models and analytics, the software, the editorial content, and the design, marks and names — are the exclusive property of The Maritime or its licensors, and are protected by copyright, database rights (including the sui generis database right), trade-mark and other laws worldwide. Substantial investment stands behind this database. Accessing the platform grants you a limited, revocable, non-exclusive, non-transferable licence to view it, for your own internal reference, through the interface we provide. No other right is granted. No ownership, and no right to extract, re-use or redistribute the contents, passes to you.

Prohibited use — no scraping, extraction or resale

You may use the platform only for lawful purposes and only as expressly permitted here. You must not, and must not permit or enable any person or system to:

• scrape, crawl, spider, harvest, index, mirror, cache for redistribution, or otherwise access the platform by any automated means — including bots, scripts, headless browsers or data-collection services;
• extract, copy, download or re-use a substantial part of the database, or repeatedly extract insubstantial parts, whether manually or automatically;
• resell, sublicense, republish, redistribute, or make the data or any derivative of it available to any third party, or use it to build, populate or benchmark a competing product or dataset;
• use the platform, its data or any output to train, fine-tune or evaluate any machine- learning or AI model;
• circumvent, disable or interfere with any access control, rate limit, authentication or security measure, or probe, scan, reverse-engineer or stress the service;
• use the platform to facilitate any activity that breaches sanctions or other applicable law.

You are responsible for all activity under your account and for keeping your credentials secure. Access is personal to you and may not be shared.

Monitoring & enforcement

We actively monitor for automated and abusive access and deploy technical countermeasures against it. Accessing the platform in breach of these terms is unauthorised access, causes The Maritime substantial and irreparable harm, and is a misappropriation of our protected database. We will pursue every available remedy without further notice: immediate termination and blocking of access, claims for damages and account of profits, injunctive and interim relief, recovery of our costs, and referral to the competent authorities under applicable computer-misuse and intellectual-property law — including, in Türkiye, the provisions of the Turkish Penal Code on unlawful access to information systems (Arts. 243–245) and of Law No. 5846 on intellectual and artistic works, and their equivalents in any jurisdiction from which access originates or in which harm is suffered. You acknowledge that damages alone would not be an adequate remedy and consent to injunctive relief.

Data accuracy — no warranty

Maritime data is aggregated from many public, official and licensed sources and is provided “as is” and “as available”, for informational purposes. We make no warranty that it is accurate, complete or current. It must not be the sole basis for any commercial, navigational, safety, insurance or compliance decision — always verify against primary and official sources.

Risk indicators and sanctions information

Scores, bands, flags and behavioural indicators shown on the platform — including any labelled as risk, AIS-gap, signal-gap or similar — are algorithmic estimates derived from observed data, not statements of fact and not a legal or compliance determination about any vessel, company or person. Where we show that an entity appears on an official sanctions list (e.g. OFAC, EU, UK, UN), that reflects the published designation of the relevant authority as of the stated date; you must confirm it against the authority’s own current list before acting. Nothing on the platform is legal, sanctions-compliance, financial or navigational advice.

Notice, correction & takedown

If you believe information about you or your organisation is inaccurate, out of date, or should not be published, or if you are a rights-holder with an intellectual-property concern, contact legal@themaritime.net. We review good-faith requests promptly and will correct or remove content where appropriate.

Limitation of liability

To the fullest extent permitted by law, The Maritime is not liable for any indirect, incidental, special or consequential loss, or for any decision made in reliance on the platform. Our total aggregate liability arising from the service is limited to the amount you paid us in the twelve months before the claim. Nothing here excludes liability that cannot be excluded by law.

Indemnity

You agree to indemnify The Maritime against claims arising from your misuse of the service or your breach of these terms or of applicable law.

Changes & law

We may update these terms; continued use after changes constitutes acceptance. These terms are governed by the laws of Türkiye, and the courts of İstanbul, Türkiye have jurisdiction, without prejudice to any mandatory consumer-protection rights. Questions? legal@themaritime.net.
